Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Autohpone Health Intelligence Private Limited ("Omna", "Omna AI", "we", "us", or "our"). By accessing or using our website (the "Site") or interacting with us via our WhatsApp Business account ("WhatsApp Chat"), you agree to be bound by these Terms. If you do not agree, you must not use our services.

Eligibility

You must be at least 18 years old to use our services. By agreeing, you represent and warrant that you meet this age requirement.

Access and Use

3.1. License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and WhatsApp Chat for personal, non-commercial purposes.

3.2. Restrictions: You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, or exploit any content from our services without our prior written consent.

User Accounts and Security

4.1. Account Creation: To access certain features, you may need to provide accurate information and create an account.

4.2. Security: You are responsible for safeguarding your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

User Content

5.1. Ownership: You retain ownership of the information and content you share via the Site or WhatsApp Chat.

5.2. License to Us: By submitting content, you grant Omna a worldwide, royalty-free, irrevocable license to use, reproduce, modify, adapt, publish, and distribute such content for the purpose of providing our services.

5.3. Prohibited Content: You agree not to share content that is unlawful, harmful, defamatory, or infringes any third-party rights.

Intellectual Property

All intellectual property rights in the Site, services, and content are owned by or licensed to Omna. Nothing herein grants you any rights to our trademarks, service marks, copyrights or other intellectual property.

Third-Party Links and Services

Our services may contain links to third-party websites or services. We do not endorse and are not responsible for their content or practices.

AI Model Training and Improvement

We may use anonymized or pseudonymized copies of your chat content to train, test, and improve our AI systems. We will not share your personal identifiers in any model-training data.

Disclaimers

The services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

We disclaim all warranties, express or implied, including accuracy, reliability, and fitness for a particular purpose.

Limitation of Liability

To the maximum extent permitted by law, Omna and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the services.

Indemnification

You agree to indemnify and hold harmless Omna from any claims arising from your breach of these Terms or your use of the services.

Termination

We may suspend or terminate your access for any reason, including breach of these Terms, without notice.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Changes to Terms

We may modify these Terms at any time by posting the revised version on the Site with an updated "Last Updated" date. Your continued use constitutes acceptance of the changes.

Waitlister Conversion

Waitlisters who become full users automatically carry over all previously granted permissions. You agree that we may continue processing your waitlist data under these Terms without a separate agreement.
